1. Assistant Administrative Officer U Nyunt Win of Kyimyindaing Township Development Affairs Department stopped the three – Thet Naing (a) Thet Naing Oo (39) (Auto Work), son of U Thu Kha of No. 697, Padindan Street, Bawga Ward, Kyimyindaing Township, Khin Maung Zaw (20), 2nd Year (Psychology) , University of Distance Education, son of U Ko Aye of No. 671, Padindan Street, Kyimyindaing and Win Myint (43) (Pandal Work), son of U Aye Kyu of No. 671, Padindan Street, Kyimyindaing Township who urinated in front of the Township Development Affairs Office at the corner of Sayyoedan Street and the Strand Road, Say/Nyein Ward in Kyimyindaing Township at 21:30 hour on (17-3-2006). The three who urinated threw the fence with stones and swore at him before leaving there. U Nyunt Win informed the Auxiliary Fire Brigade which was discharged at Thiri Mingalar Market and 10 Fire Brigade members including Platoon Commander Zaw Linn and Sergeant Myat Thant of the Auxiliary Fire Brigade arrived at the Township Development Affairs Office.

2. When they arrived there, they found that the three including That Naing (a) Thet Naing Oo also arrived back and clashed with Assistant Administrative Officer U Nyunt Win. They stopped and mediated them. But Thet Naing (a) Thet Naing Oo, one of the three who urinated, slashed at Sergeant Myat Thant and Platoon Commander Zaw Linn with the 18 inches long sword and fled away. Sergeant Myat Thant wounded at his right forearm and Platoon Commander Zaw Linn also wounded at his right forearm.

3. Members of the Auxiliary Fire Brigade followed Thet Naing (a) Thet Naing Oo who fled away after slashing. Trishaw men Maung Zaw, Nay Win Tun, Tun Naing (a) Kyar Lay and Than Htaik (a) San Shay who were nearby helped and caught him. Thet Naing (a) Thet Naing Oo defended himself slashing at them with the sword. Tun Naing (a) Kyar Lay, Tin Hlaing and Maung Zaw threw him with stones and Than Hteik (a) San Shay beat him 7 feet long bamboo pole. Thet Naing (a) Thet Naing Oo was swollen at his back of the head and unconscious because of the beating of Than Hteik (a) San Shay with 2 feet 4 inches long wooden rod. He was sent to the Neuro Department of Yangon General Hospital via the Western Hospital. The sword held by Thet Naing (a) Thet Naing Oo, a wooden rod used by Than Htike (a) San Shay, a bamboo pole and stones used by Nay Win Tun while the case was occurring were seized as exhibits.

4. Concerning the consequences, Auxiliary Fire Brigade Platoon Commander Zaw Lin and Sergeant Myat Thant filed Thet Naing (a) Thet Naing Oo who committed to cut them with the sword. Kyimyindaing Police Station opened the case (pa) 319/2006 with the act of 333. Similarly, the Station informed mother Daw San Yee to open the case for her son Thet Naing (a) Thet Naing Oo who was also beaten. On behalf of the beaten son, the mother opened the case (pa) 320/2006 with the act of 326. Because of head injury, Thet Naing (a) Thet Naing Oo died at 10:40 hours on 18-3-2006. The act of the case was then changed to 302. In-charge of Kyi Myindaing Police Station Police Lieutenant Nay Myoe investigated with the remand to five persons including Than Htike (a) San Shay.

5. At 13:55 hours on 19-3-2006, Kyimyindaing Township Development Affairs Department Administrative Officer U Kyi Soe filed the three persons including Thet Naing (a) Thet Naing Oo for urinating near the office gate and impolite verbal responses to Assistant Administrative Officer U Nyunt Win, Deputy Supervisor U Tet Toe and permanent staff U Tin Naing Tun.

Therefore, Kyimyindaing Police Station opened the case with Non-Cognizable Offence No. 11/2006 and Yangon, Police Act 40/15.

6. Thet Naing (a) Thet Naing Oo was formerly a member of both New Democratic Society Party and BaKaTha. During the 1988 disturbances, he went underground and returned to the legal fold in 1991 and came back to Kyimyindaing. He was sentenced to 10 years imprisonment according to 1998 Emergency Administration Act 5 (Nya) and Unlawful Association Act 17 (1). On 21-11-2002, he was set free from Thayawaddy Prison according to the Criminal Procedure Act 401.

7. The case was due to uncontrollable situation of an unruly drunkard who died conditioning to the involvement of the environment and the public. The Police Station is undertaking conjoint investigation on the cases opened by both sides and legal action will be taken according to the law.
